Thanks Guys. My camera is not the best one but it gets the point across on what they look like at least. I am waiting for another rescue. Have to meet them when they call. Hope they won't be too much longer. I think like 5 or 6 fish in this one. So a smaller rescue.

Are you set up for salt water fish rescue too?

Yep Patti I am. I used to have salt water for a few years...so I have all the stuff needed for that as well. As a matter of fact on the first rescues I did was one saltwater tank and one freshwater tank after the owner past away his family did not know what to do with it. Right now I am holding a few brackish water fish...which is half way between salt and freshwater.

About two months ago I took in three Hardhead Sea Catfish. They are saltwater and poisonous. My catfish guy took them. Loves is catfish.

No updates with the case as of yet. However, new updates regarding my second furnace. It has been acting up all the time too now, and as of today quit working too. In the process of fixing it, a loud bang and sparks flew. The control board fried on it. Now both furnaces are giving me issues. Hopefully he will be back today with the part as my basement is getting pretty cold and the fish don't like that.

Sorry to hear this. I have no idea how you are coping with all of this. I would have freaked on this company and the repair men that can't seem to fix the problems. They would not like me. lol

Hope things get better soon.

In the meantime I do hope some more donations to help keep your fish rescue up and running are still coming in. I do know how important donations are in order to keep your business going. It is so important to have a fish rescue and I think you are the only one in our state?

Patti, coping with this has been so extremely stressful. To try and maintain my professionalism and sanity has been very trying at times. I have to keep telling myself I have a business name to represent. If I fly off the handle and start doing bad things, it reflects not only on me but my business as well. I am so tired of fighting and begging and now with the issues with the second furnace, it is just a nightmare.

They are coming in tomorrow to fix the things that were not up to building code. The investigation is still ongoing. And no, there hasn't been any donations in a long time.

I got a call from a lady all the way from Texas who rescued a fish a university student left behind. A 8 and a half inch fish currently is living in a 10 gallon aquarium. She found me by searching the Internet. She called and begged me to help find a home for this fish. With me being how many miles away I told her all I can do is find areas where she is that may want it. So I have been on the phone and emailing and have posts on other fish forums. Hopefully I can help her out with me being so far away.

Things just seem to be going from bad to worse here. I am at my wits end and finding it very hard to stay focused these days. I was asked to share what last happened here regarding the whole furnace issues that seem to be never ending.

My furnace guy was in last week Tuesday to fix the building code violations. Before he left he made sure he had lots to tell me. He mentioned he is done with this and his hands are done with this whole mess. He took out a "comfort plan" which gives other YORK people the right to come in if something breaks. He bought this out of his own pocket. I told him and who do you think I can get from YORK when the other local ones said they won't touch your work with a ten foot poll? We argued with that for a while with no resolution.

Then he and others have said that he has done nothing wrong. It is all the right equipment and nothing is his fault. How others agrees that at this point they feel I am sabotaging the equipment cause there is no way two furnaces could be faulty. I looked at him and said I would bet my kids lifes that I did not touch any furnace down there. He said I find that hard to believe and don't believe you. Along with that letter I wrote in the paper. How it was only written to cause him grief and the rumors I am spreading in town about him. I said, did you see your name in that letter? No. Could I have, yes. He said legally I could not. I said are you sure about that because I have a lawyer who told me that if it was her she would say your name in every other sentence. I have nothing to hide and it was all the truth. BUT...that letter was to help me save my business, not to personally bash you. He didn't agree with that either. Said that he lost his a$$ three times over on this job. He has taken such a loss on this job.

Well....I got the "comfort plan" in the mail. It only lists the ONE furnace. I asked what about all my other equipment and I was told that they are off warrantee. I said What? No they are not. The guy from Ferguson said Josh told him they were. I read my contract word for word that my equipment comes with a 5 YEAR PARTS AND LABOR. He was shocked that Josh told him differnent. He was going to check in on it. Well, I get a call back yesterday and was told that YORK will NOT honor this company's warrantee. All they will honor is the comfort plan he took out. If I want the 5 years on all of it like my contract said, I will have to go back to Josh for it. So here I sit with being told that because Josh backed out on this whole mess, YORK WILL NOT honor his warrantee plan he had with me. So if something goes out in the other 3 pieces of equipment only certain things are covered yet under manufacturer's warrantee but I am responsible for all labor costs. How is this fair to me when I paid $8500 for all this WITH a 5 year parts and labor on all my stuff?

I am at my wits end here. I do not know what to do anymore. Easy thing would be to hire an attorney...but I do not have the money for that at all. Finned Friends and KARS is barely keeping it's doors open with paying just shy of $700 a month to the electric company. Unless a miracle comes in this month I will be about $400 short on what needs to be paid to keep this going for the month of July. This is killing me as I am the victim here and I am treated like I am the bad person in this whole mess.

Please, anyone...if you know any attorney's or anyone that could help me...I am being literally taken advantage of. Tell everyone you know that loves fish about me and maybe they would be willing to send a small donation in to help me meet my goal this month. I am on my knees praying to God for answers and help to keep the faith that this will all work out.

I'm so sorry to read that things are still going so badly for you.

Sounds like a few people in your little town simply want to see you out of business or something. What I don't understand is that you are the victim and the work was not done correctly (reading from your previous posts here)...and the detectives felt they had a case. .. So, why aren't they doing something? And if there is a case, wouldn't a lawyer take it seeing that you have a possible lawsuit without a huge retainer fee?

We were in an accident years ago and we sued the person's insurance company and never paid out a dime to our lawyer up front. He took his fee out of the money in the end.

I really don't want to sound as if I know about the law in this situation but seriously there seems as if something could be done. Have you contacted the States Bar Association to see if they can give you advice as to where to go with all of this? Or couldn't you apply for Legal Aid?

Sorry I seem to be out of ideas for you. I really wish something comes up for you and soon.

Yes, the Investigators are still working on the Fraud aspect of the case with good enthusiasm. However, it all takes time to build a case that the DA's office will agree to pursue. He has been over here several times and is working very hard on the case. This just adds more to the case if my contractor does not follow through with the warrantee.

I did talk again to a local attorney...the one who told me to go the fraud route for quite a while yesterday. He again listened to all the new stuff that was going on and said to me, well, I have one word of advice..........then he paused and said he was sorry...he guesses he doesn't have any words of advice. Except this is a huge mess. He still thinks my best effort is to go the fraud route as in anything he can do would be civil and be dismissed in a bankruptcy. The DA can make this criminal and therefore could not be threw in court.

I am just at a loss that YORK won't stand behind much of this. If any. I don't know where to turn with this anymore and my fate is in the hands of the Police Deparment and the DA's office.

Keep up the good fight. It's very hard when you rescue something other then dogs or cats. Many more see the need to help a dog or cat in need and not see the fish, wildlife, hooved animals needing help.

None of them have a voice to ask for help when needed.
